Applicability: For the purposes of the Regulations, software product means computer software, software embedded in information systems or equipment, or computer software provided together with integration or application services for computer information systems (Article 3).

Main contents: Article 2 of the Measures states that a software enterprise certified in accordance with these Measures is entitled to enjoy the preferential policies provided in State Council, Encouraging the Development of the Software and Integrated Circuit Industries Several Policies. An enterprise may be certified as a software enterprise if it satisfies the conditions set out in Article 12. These conditions include 50% or more of technical personnel engaged in software development and technical services, 35% or more of annual revenue from software, and 8% or more of software revenue allocated for software research and development. Certifying institutions shall be recommended by the provincial information industry authorities and authorized by the Ministry of Information Industry (Article 6). These institutions are responsible for the certification and annual review of software enterprises (Article 8). Integrated circuit design enterprises shall be certified by reference to the conditions and Measures applicable to the certification of software enterprises (Article 20).
