Applicability: For the purposes of the Measures, a "Foreign government loan project" means a project using foreign government loans and other foreign preferential loans as stipulated by the State Council; and a "Procurement company" means an enterprise that has had foreign trade rights for more than three years and, in the case of a project worth US$5 million or more, an International Tendering Qualifications Class One Certificate issued by the relevant authority of the State Council (Section One).
Main contents: The Measures state that the Ministry of Finance, upon receipt of the relevant document for a foreign government loan project from the State Development Planning Commission, will notify the procurement companies concerning the project and the Ministry's local departments shall timely notify the project implementing party to commence tendering for a procurement company (Section Two). The project implementing party shall invite at least three procurement companies to bid (Section Three). Each invitee may submit an agent application which shall be evaluated on a point system (Sections Four and Five). Points are awarded for the applicant's performance in the last three years, its ISO certification, the qualifications of its procurement personnel, and other factors (Section Six). The applicant earning the most points will be declared the winner (Section Seven). The results will be reported to the Ministry of Finance and, upon receiving the ministry's reply, the project implementing party shall enter into an agency agreement with the winning applicant (Section Nine).
