Applicability: The Regulations would apply to the organizations, individuals and their activities in Zhongguancun Science and Technology Park, which includes Haidian Park, Fengtai Park, Changping Park, Electronic City Science and Technology Park, Yizhuang Science and Technology Park and other areas of Beijing that may be designated by the municipal government pursuant to the approval of the State Council, with Haidian Park as its core area (Articles 2 and 3).
Main contents: According to the Regulations, an organization or individual may engage in any activity in the Park not expressly prohibited by law or regulations unless it is detrimental to the public interest, disrupts the social or economic order or breaches public morals (Article 7). The scope of business of enterprises in the Park will not be subject to approval by the administration of industry and commerce except for those business areas that are restricted by law or regulations (Article 9). Qualified overseas professionals and professional service firms will be permitted to practise in the Park (Article 15). The government will provide support for academic and research institutions and researchers participating in various types of business/research activities in the Park, including the creation of "high technology incubators" (Articles 13, 14 and 17). The Regulations allow venture capital firms to invest in the Park their entire capital (Article 25). The Regulations prohibit any restrictions on competition, including abuse of economic dominance, restriction of trade and administrative restrictions (Articles 18 to 22). The Regulations also contain detailed provisions regarding the protection of intellectual property rights, including the intellectual property rights to online information and the confidentiality obligations of employees during and after employment (Articles 38 to 43).
